MindGPS – Terms of Use

Please read these Terms carefully. By ticking “I agree” and using MindGPS (the “App”), you confirm that you have read, understood and accept these Terms. If you do not agree, please do not use the App. In these Terms, “we”, “us” and “our” mean the operator of MindGPS, and “you” means the user.
1. What the App is
1.1 The App offers readings based on traditional Chinese numerology and Five Elements theory, together with daily energy cards, for general reference, self-reflection, personal growth and entertainment.
1.2 These traditions are cultural and philosophical, not scientific. Readings describe possible tendencies only. They are not predictions, guarantees or statements of fact about you or any other person.
2. Not professional advice
2.1 Nothing in the App is medical, psychological, legal, financial, investment, tax, career, relationship or any other professional advice, and it must not be relied on as such or used in place of advice from a qualified professional.
2.2 Health-related content reflects a traditional wellness perspective only. It cannot diagnose, treat, cure or prevent any condition. Always consult a doctor or qualified professional about your health, and never delay or ignore professional advice because of something in the App.
2.3 Pro tools (partner match, candidate fit, team map and success path) are for reflection and discussion only. You must not use them as the sole or main basis for hiring, firing, promotion, pay or any other employment or business decision, and you are responsible for complying with employment, anti-discrimination and data protection laws, including obtaining consent before entering another person's details.
2.4 If you are in crisis or facing an emergency, contact your local emergency services or a qualified professional immediately.
3. Your responsibilities
3.1 You are solely responsible for your decisions and actions, including any made after using the App.
3.2 You must be at least 18 years old, or use the App with the consent and guidance of a parent or guardian.
3.3 Only enter another person’s details (for example a family member’s birth date) where you have a reasonable basis to do so, and use the results respectfully.
3.4 You must not misuse the App, including by copying, scraping or reverse-engineering it, attempting to bypass the member lock, or using it for any unlawful purpose.
4. Credits and member codes
4.1 Full readings and PDF reports are unlocked with credits, or with a member code we give you. Credits are bought in one-time packs through Stripe; there is no subscription and nothing renews automatically.
4.2 Bought credits do not expire. They have no cash value, cannot be transferred or exchanged for money, and are non-refundable once used. Unused credits may be refunded at our discretion within 14 days of purchase.
4.3 Opening a person's full reading uses credits once; that person stays open on your account. Signed-in users receive free monthly credits, which reset on the 1st of each month (Singapore time), do not roll over, are used before bought credits, are limited to one account per person and may be changed or withdrawn at any time.
4.4 Member and access codes are personal and must not be shared, sold or published. We may suspend a code or account that is shared or misused, or where these Terms are breached. We may change prices, credit costs and features from time to time; changes do not affect credits you already hold.
5. Intellectual property
5.1 All content in the App, including readings, texts, designs, card artwork, logos and software, is owned by or licensed to us and is protected by copyright and other laws.
5.2 You may use the App for your own personal, non-commercial purposes. You may share energy card images on social media for personal use, provided the MindGPS branding is kept intact.
5.3 You must not copy, reproduce, translate, sell, teach from or commercially use the App’s readings or other content without our prior written permission.
6. Privacy and your data
6.1 Birth details and saved profiles you enter are stored on your own device (in your browser). We do not receive them unless you send them to us. Clearing your browser data, or deleting a profile, removes them from that device.
6.2 When you enter a member or access code, the code is sent to our server only to check whether it is valid. To unlock readings or prepare a PDF report, the App sends our server a short coded fingerprint of the birth details and the combination numbers needed; it does not send names.
6.3 To sign in, you give us your email address. We use it to send you a one-time code, to keep one account per person for the free monthly credits, and to link any credits you buy. If you tick the box, we may also send you news about our courses and events; you can unsubscribe at any time.
6.4 Payments are processed by Stripe. We do not see or store your full card details. Stripe holds your email address, payment records and credit balance on our behalf.
6.5 We do not sell your personal data. We handle any personal data we receive in accordance with Singapore’s Personal Data Protection Act 2012 (PDPA). You may contact us about your personal data at any time.
7. Availability and changes
7.1 The App is provided “as is” and “as available”. We do not guarantee that it will be uninterrupted, error-free or that its content is complete or accurate.
7.2 We may update, change, suspend or discontinue any part of the App at any time.
8. Limitation of liability
8.1 To the fullest extent permitted by law, we and our founders, teachers, partners and service providers are not liable for any direct, indirect, incidental, special or consequential loss or damage (including loss of income, opportunity, data or goodwill, or any personal, health, financial or relationship outcome) arising from your use of, or reliance on, the App or its content.
8.2 Where liability cannot be excluded, our total liability to you is limited to the amounts you paid to us in the 12 months before the event giving rise to the claim.
8.3 Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under the law of Singapore.
9. Indemnity
You agree to indemnify us against any claim, loss or cost arising from your breach of these Terms or your misuse of the App.
10. Changes to these Terms
We may update these Terms from time to time. The date at the top shows the latest version. If we make significant changes, the App will ask you to read and accept the updated Terms. Continuing to use the App after an update means you accept the updated Terms.
11. Governing law
These Terms are governed by the laws of Singapore. Any dispute will be subject to the exclusive jurisdiction of the courts of Singapore.
12. General
If any part of these Terms is found unenforceable, the rest remains in effect. These Terms are provided in English and Chinese; if there is any inconsistency, the English version prevails.

1. 本应用的性质
1.1 本应用依据中国传统数字命理及五行理论，提供解读与每日能量卡，供一般参考、自我觉察、个人成长及娱乐之用。
1.2 上述理论属于文化与哲学传统，并非科学结论。解读仅描述可能的倾向，并非对您或任何人的预测、保证或事实判断。
2. 不构成专业意见
2.1 本应用的任何内容均不构成医疗、心理、法律、财务、投资、税务、职业、婚恋或任何其他专业意见，不应作为依据，也不能取代合格专业人士的意见。
2.2 涉及健康的内容仅为传统养生观点，不能用于诊断、治疗、治愈或预防任何疾病。有关健康问题请务必咨询医生或合格专业人士，切勿因本应用的内容而延误或忽视专业意见。
2.3 专业版工具（合伙配对、人才适配、团队图及成功路径）仅供参考与讨论。您不得将其作为招聘、解雇、晋升、薪酬或任何其他雇佣或商业决定的唯一或主要依据，并须自行遵守雇佣、反歧视及个人资料保护等法律，包括在输入他人资料前取得其同意。
2.4 如遇危机或紧急情况，请立即联系当地紧急服务或合格专业人士。
3. 您的责任
3.1 您须对自己的决定和行为（包括使用本应用后作出的决定）承担全部责任。
3.2 您须年满18岁，或在父母或监护人同意及陪同下使用本应用。
3.3 输入他人资料（例如家人的出生日期）时，须有合理依据，并以尊重的态度使用结果。
3.4 您不得滥用本应用，包括复制、抓取或反向工程本应用，试图绕过会员锁，或将其用于任何违法目的。
4. 点数与会员码
4.1 完整解读及 PDF 报告需使用点数或我们提供的会员码解锁。点数通过 Stripe 以一次性礼包购买，不设订阅，亦不会自动续费。
4.2 购买的点数永不过期，不具现金价值，不可转让或兑换现金，使用后不予退款。未使用的点数可于购买后 14 天内由我们酌情退款。
4.3 打开某人的完整解读只扣一次点数，此人在您的账户中永久保持打开。登录用户每月可获免费点数，于每月 1 日（新加坡时间）重置、不可累积、优先于购买点数使用，每人限一个账户，我们可随时调整或撤回。
4.4 会员码及开通码仅限本人使用，不得分享、出售或公开。如有分享或滥用，或违反本条款，我们可暂停相关代码或账户。我们可不时调整价格、点数用量及功能，但不影响您已持有的点数。
5. 知识产权
5.1 本应用的所有内容，包括解读、文字、设计、卡片图案、标志及软件，均归我们所有或经授权使用，受版权及其他法律保护。
5.2 您可将本应用用于个人非商业用途；在保留 MindGPS 品牌标识的前提下，可在社交媒体上分享能量卡图片作个人用途。
5.3 未经我们事先书面许可，您不得复制、转载、翻译、出售、用于教学或商业使用本应用的解读或其他内容。
6. 隐私与资料
6.1 您输入的出生资料及已存档案保存在您自己的设备（浏览器）中。除非您主动提供，我们不会收到这些资料。清除浏览器数据或删除档案，即会从该设备上移除。
6.2 输入会员码或开通码时，该码仅会发送至我们的服务器以验证是否有效。为解锁解读或生成 PDF 报告，本应用会向服务器发送出生资料的简短编码指纹及所需的联合数字，不会发送姓名。
6.3 登录时，您需提供电子邮箱。我们用它发送一次性验证码、确保每人一个账户以领取每月免费点数，并关联您购买的点数。如您勾选同意，我们亦可能向您发送课程及活动消息，您可随时取消订阅。
6.4 付款由 Stripe 处理。我们不会看到或保存您的完整银行卡资料。Stripe 代我们保存您的电子邮箱、付款记录及点数余额。
6.5 我们不会出售您的个人资料，并依照新加坡《2012年个人资料保护法》（PDPA）处理我们收到的任何个人资料。您可随时就个人资料与我们联系。
7. 服务提供与变更
7.1 本应用按“现状”及“现有”基础提供。我们不保证其不中断、无错误，或内容完整准确。
7.2 我们可随时更新、更改、暂停或终止本应用的任何部分。
8. 责任限制
8.1 在法律允许的最大范围内，我们及我们的创办人、导师、合作伙伴与服务供应商，对因您使用或依赖本应用及其内容而产生的任何直接、间接、附带、特殊或后果性损失或损害（包括收入、机会、资料或商誉损失，以及任何个人、健康、财务或感情方面的结果）概不负责。
8.2 如责任无法排除，我们对您的全部责任以引起索赔事件前12个月内您向我们支付的款项为上限。
8.3 本条款不排除或限制新加坡法律规定不能排除或限制的任何责任。
9. 赔偿
如因您违反本条款或滥用本应用而导致任何索赔、损失或费用，您同意向我们作出赔偿。
10. 条款修改
我们可不时更新本条款，最新版本以页首日期为准。如有重大修改，本应用会请您重新阅读并同意。更新后继续使用本应用，即表示您接受更新后的条款。
11. 适用法律
本条款受新加坡法律管辖。任何争议由新加坡法院专属管辖。
12. 其他
如本条款任何部分被认定无法执行，其余部分仍然有效。本条款以英文及中文提供；如两者有任何不一致，以英文版本为准。
